Terms and Conditions of Sale and Installation

Version: 1.0
Effective Date: 05/09/2026

1. About Us

These Terms and Conditions apply to all quotations, contracts, sales and installation work carried out by Cherry Tree Glazing Ltd ("we", "us", "our").

These terms explain your rights and responsibilities and ours. They do not affect your statutory rights under UK consumer law.

2. Definitions

Customer means the person or organisation placing the order.

Goods means any windows, doors, glass, frames, hardware or other products supplied by us.

Services means surveying, measuring, manufacturing, delivery, installation, repairs or other work carried out by us.

Contract means the agreement between Cherry Tree Glazing Ltd and the Customer.

3. Quotations

Our quotations are valid for 30 days unless stated otherwise.

Quotations are based on information available at the time. If additional work becomes necessary due to hidden defects or circumstances that could not reasonably have been identified during the survey, we will discuss this with you before carrying out any additional work.

A quotation does not create a contract until accepted by both parties.

4. Orders

An order becomes binding once:

  • you accept our quotation; and
  • we confirm acceptance of your order.

Any changes requested after acceptance may affect the price, delivery date or installation schedule.

5. Surveys and Measurements

Where required, we will carry out a site survey before manufacture.

Manufacturing will normally begin only after final measurements have been approved.

Minor variations in dimensions, colour, finish or appearance that are within normal manufacturing tolerances do not constitute defects.

Depending on the survey size and the amount of work within the survey and quotation period, an agreed amount will be required.

6. Price

The contract price includes only the work listed in our quotation.

Unless specifically stated, the price does not include:

  • structural alterations;
  • plastering;
  • decorating;
  • electrical work;
  • plumbing;
  • asbestos removal;
  • scaffolding;
  • specialist lifting equipment;
  • making good beyond normal installation finishing.

If unforeseen work is required, we will explain the reasons and provide a price before continuing where reasonably possible. This may delay works to commence until a reasonable solution has been agreed upon by both parties.

7. Deposits and Payments

A deposit is required before manufacture begins.

50% of the contract amount is taken as a deposit.

The remaining 50% is split into two payments.

40% prior to the installation start date.

The remaining balance becomes due immediately upon substantial completion and satisfactory sign off, of the installation unless otherwise agreed in writing.

Payments made by credit cards, may have a fee which will be agreed upon at the time of purchase.

We reserve the right to charge statutory interest and reasonable recovery costs on overdue commercial accounts.

For consumer customers, we may charge interest on overdue sums only where this has been clearly agreed in advance and is permitted by law.

Ownership of goods remains with Cherry Tree Glazing Ltd until payment has been received in full.

8. Cancellation Rights

Where your contract is made away from our business premises or online, you may have the legal right to cancel within 14 days under the Consumer Contracts Regulations.

If you ask us to begin work during the cancellation period, you expressly request an early start.

If manufacturing of bespoke goods begins with your agreement, your cancellation rights may change because made-to-measure products are generally exempt from the standard cancellation right once production has started.

Where cancellation is permitted after work has begun, you may be required to pay for work already carried out.

Cancelling within the 14 day period, you may endeavour fees covering the cost, for example, materials ordered, time taken during the surveying, quotation and ordering processes.

9. Delivery

Delivery dates are estimates unless specifically agreed otherwise.

We are not responsible for delays caused by:

  • suppliers;
  • manufacturers;
  • weather;
  • transport issues;
  • events outside our reasonable control;
  • customer delays.

We will keep you informed if delays occur.

10. Access

You agree to provide:

  • safe access;
  • suitable parking where available;
  • access to electricity where reasonably required;
  • clear working areas.

You are responsible for removing valuable or fragile items from the work area before installation.

If our installers are unable to work because access has not been provided, we may charge reasonable additional costs.

11. Installation

Our installers will take reasonable care while carrying out the work.

Some minor damage to plaster, render, decoration or surrounding finishes can be unavoidable when removing existing windows or doors.

Unless specifically included within the quotation, decorating, plaster repairs and redecoration are not included.

Old windows, doors and glass removed during installation become our property for disposal unless otherwise agreed.

We use a registered waste disposal company; we will require space to store and dispose of all frames and glass. We will book the waste removal firm to collect and remove all waste from site, during the install time, if for whatever reason, availability isn’t achieved we will keep the customer up to date with a collection date and approximate time.

12. Building Regulations

Where applicable, installations will comply with current Building Regulations.

Where we are registered with a Competent Person Scheme, we will arrange the appropriate compliance certification.

If certification cannot be issued because work outside our control prevents compliance, we will explain the position and any options available.

13. Glass

Glass is manufactured to recognised industry standards.

Minor imperfections that cannot normally be seen from a reasonable viewing distance in natural daylight are not considered defects. 2 meter rule stated throughout the industry.

Condensation on the outside surface of modern energy-efficient glazing is a normal occurrence under certain weather conditions and is not a fault.

Our installation workmanship is guaranteed for 2 years. Unless agreed otherwise.

Please notify us as soon as reasonably possible if you believe there is a fault.

Where appropriate, we will inspect the issue and, if the goods or services do not meet the standards required by law or the contract, we will repair, replace or otherwise provide an appropriate remedy.

Where a defect or fault has occurred, this will be resolved as soon as possible once it has been reported. If for instance, a movable part needs replacing, i.e. a handle at the end of installation, or other defaults, the remaining balance will still be payable on completion with a holding good will gesture amount agreed.

17. Customer Responsibilities

You agree to:

  • provide accurate information;
  • ensure permissions have been obtained where required;
  • advise us of concealed services such as pipes or cables where known;
  • keep children and pets away from work areas.

18. Delays Outside Our Control

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including severe weather, industrial disputes, shortages of materials, transport disruption, fire, flooding or government restrictions.

Where possible, we will agree a revised installation date.

19. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any rights that cannot legally be excluded under UK law.

Subject to the above, we are responsible only for losses that are reasonably foreseeable as a result of our breach of contract or negligence.

We are not responsible for indirect or consequential losses unless the law requires otherwise.

Your information will only be used for purposes connected with your enquiry, order, installation and any legal obligations.

We aim to investigate complaints promptly and work with you to reach a fair resolution.
